Job Descriptions:

The Sharia Advisor shall have the following duties and responsibilities:

to make available the parameters in relation to activities including but not limited to financial transactions and services carried out by the BMA Islamic Banking;

to provide and propose possible Sharia compliant solutions for Sharia compliance problems in financial transactions;

to provide advice, guidance and assistance in the development and structuring of Sharia compliant products and services of the BMA Islamic Banking as well as assisting in developing its business in accordance with international best practice, inclusive of its policies and procedures;

in the event of possible failure by the management of the BMA Islamic Banking to follow the decisions and fatwa of the Sharia Board, it shall be able to inspect the records and documents of the BMA Islamic Banking or provide it with data required by it, the Sharia Board shall report such failure to the Board of Directors of BMA with suitable recommendations to enable the Board of Directors to take appropriate decision;

to do an annual review of the BMA Islamic Banking to ensure its Sharia compliance in its activities, inclusive of:

  1. reviewing contracts, agreements, policies, products, transactions, memorandum and articles of association, financial statements, reports in relation to Sharia compliant transactions, products and services offered by the BMA Islamic Banking (also pertaining to internal audit and internal BMA Islamic Banking inspection, circulars or anything substantially similar in nature);
  2. obtaining an understanding of the management of the BMA Islamic Banking awareness, commitment and compliance control for adherence to Sharia in respect of the Islamic Banking activities;
  3. determining whether transactions in relation to Sharia compliant transactions, products and services offered by the BMA Islamic Banking entered into during the year were in line with guidelines approved by the Sharia Board and DAB’s regulations;
  4. consulting with the BMA Islamic Banking service providers and external auditors; and
  5. discussing preliminary findings with the management of the BMA;to produce report subsequent to the review above, in such format and at such intervals  in conformity with the directions issued by the AAOIFI or such other relevant institution or body as dictated by legal and market standards applicable to banks and financial institutions offering Sharia compliant products and services.

Job Requirements:

Educational and certification:

The proposed Sharia Advisor shall at least either have qualification or possess necessary knowledge, expertise or experience in the following areas:

(a) Must have Master or Bachelor Degree in Shari 'at Fiqah and law.  

(b) Islamic jurisprudence (Usul al-Fiqh);    

(c) Islamic transaction/commercial law (Fiqh ul-Mu'amalat).   

(d) Knowledge of or at-least familiarity with the banking industry.   

Experience

Strong knowledge of Shariah & law or Fiqh ul Mu'amalat or experience of at  least 3 years giving religious rulings or Banking experience. 
Knowledge of or at-least familiar with the banking industry. 

Knowledge-Skills-Abilities:

Adequate understanding of Shaira as well as the bank's business, operations and risks;
Proficiency in local languages, both oral and written

Proficiency in Arabic and English
Excellent communication skills;

TRACK RECORD 

  • The Shariah Advisor must have an faultless track record in the companies he/she has served either in the capacity of an employee or director/chief executive or as chairman.
  • Has not given any wrong fatwa’s on Islamic Finance transactions. 
  • Has not been associated with any illegal activity especially relating to banking business. 
  • Has not been convicted any criminal offence, involved in any fraud/forgery, financial crime etc. 
  • Has not been disqualified.
